Welcome to CommonHouse. These Terms and Conditions ("Terms") govern your use of the CommonHouse website (commonhouse.sbs) and the services offered by CommonHouse ("we," "our," or "us"), a company registered in the United Kingdom with registration number 85511145.
By accessing our website, booking our services, or otherwise engaging with us, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our website or services.
Please read these Terms carefully before proceeding. We recommend that you print a copy of these Terms for future reference.
In these Terms, the following definitions apply:
We make every effort to ensure that the information on our website is accurate and up-to-date. However, we do not guarantee the completeness, reliability, or accuracy of this information. Descriptions of accommodations, facilities, and services are based on information provided by our Travel Suppliers and may change without notice.
All content on our website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of CommonHouse or our content suppliers and is protected by international copyright laws. You may not reproduce, distribute, modify, display, or create derivative works from any content without our express written consent.
When using our website, you agree not to:
Our website may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content or security of these websites and accept no responsibility for them or for any loss or damage that may arise from your use of them.
By making a booking with us, you confirm that you have the authority to accept these Terms on behalf of yourself and all members of your party. The lead booker is responsible for ensuring that all members of the party are aware of and agree to these Terms.
A contract between us comes into existence when we issue a Booking Confirmation. Prior to this, any quotation given is subject to change without notice.
You are responsible for providing accurate and complete information when making a booking. This includes correctly spelling names as they appear on passports and providing accurate contact details. Any costs incurred due to inaccurate information are your responsibility.
To confirm a booking, a deposit of 25-30% of the total tour cost is required at the time of booking, unless otherwise specified. The remaining balance must be paid 60-90 days before departure, as indicated on your Booking Confirmation.
For bookings made within 90 days of departure, full payment is required at the time of booking.
Payment can be made by credit/debit card or bank transfer. All payments must be made in the currency specified in your Booking Confirmation.
While we make every effort to ensure that prices quoted are accurate, we reserve the right to change prices in the following circumstances:
We will notify you of any price changes as soon as possible. If a price increase exceeds 8% of the total tour cost, you have the right to cancel your booking and receive a full refund.
We will make reasonable efforts to accommodate special requests (such as dietary requirements, room preferences, or accessibility needs), but we cannot guarantee that these requests will be met. The inability to meet a special request does not constitute a breach of contract on our part.
You are responsible for ensuring that you have all necessary travel documents, including valid passports, visas, health certificates, and insurance policies. Your passport should be valid for at least six months beyond your planned return date.
We will provide guidance on travel document requirements, but it is your responsibility to check and comply with the entry requirements for the countries you are visiting.
It is a condition of booking that you have comprehensive travel insurance covering medical emergencies, evacuation, cancellation, and other travel-related risks. We reserve the right to request proof of insurance before departure.
If you choose to travel without adequate insurance, we will not be liable for any losses or expenses that would otherwise have been covered by insurance.
You are responsible for obtaining any recommended vaccinations and health precautions for your destination. We recommend consulting with a travel health professional or visiting a travel health clinic well in advance of your departure.
If you have any medical conditions or disabilities that may affect your travel, you must inform us at the time of booking so that we can advise on the suitability of your chosen arrangements.
If you wish to change any part of your booking after the Booking Confirmation has been issued, you must inform us in writing as soon as possible. While we will make reasonable efforts to assist with changes, we cannot guarantee that changes will be possible. An administration fee of $75 per person may apply, in addition to any costs imposed by our Travel Suppliers.
Significant changes, such as changing dates or destinations, may be treated as a cancellation and rebooking, subject to our cancellation charges.
If you need to cancel your booking, you must notify us in writing. Cancellation charges will apply as follows:
Depending on the reason for cancellation, you may be able to reclaim these charges under your travel insurance policy.
We reserve the right to make minor changes to your booking if necessary. Minor changes include changes to accommodations of similar or higher standard, changes in transportation, or alterations to itineraries that do not significantly affect the nature of the tour.
If we need to make a significant change to your booking (such as changing the destination or significantly altering the itinerary), we will inform you as soon as possible and offer you the following options:
In rare circumstances, we may need to cancel your booking. This might occur if:
If we cancel your booking (except due to your failure to pay or inappropriate behavior), we will offer you an alternative tour if possible or a full refund. In addition, we may offer compensation, except in cases of Force Majeure or failure to reach minimum numbers.
We are responsible for the proper performance of the services included in your booking. If any of these services are not performed as described in your Booking Confirmation, or if they are performed improperly, we will pay appropriate compensation unless the improper performance is:
Many of the services that make up your tour are provided by independent Travel Suppliers. These suppliers provide services subject to their own terms and conditions. Some of these terms may limit or exclude the supplier's liability to you.
We accept no responsibility for the actions or omissions of Travel Suppliers or for any services which do not form part of our contract with you.
You are expected to behave responsibly, respectfully, and lawfully throughout your tour. If in our reasonable opinion, you behave in a way that causes or is likely to cause danger, upset, or distress to others or damage to property, we may terminate your tour without any liability on our part.
You will be responsible for any damage or losses caused by you. Full payment for any such damage or losses must be made directly to the affected party.
If you have a complaint during your tour, you must inform our local representative or tour guide immediately, so that they have the opportunity to resolve the matter. If the problem cannot be resolved locally, you should contact us at our office.
If you remain dissatisfied, you must write to us within 28 days of your return, providing all relevant information. Failure to follow this procedure may reduce or deny any claim for compensation.
Our liability for claims arising from your booking is limited as follows:
These limitations are subject to applicable international conventions, including the Warsaw Convention, the Athens Convention, the Berne Convention, and the Paris Convention.
We may provide information about activities and excursions that are available in your destination. These activities and excursions are not operated or supervised by us, and we do not accept liability for any injury, loss, or damage arising from your participation in them.
We will not be liable for any failure to perform or delay in performing our obligations under these Terms due to Force Majeure Events. In such circumstances, we may cancel, delay, or alter your tour and our only obligation will be to offer you an alternative tour or a refund for services not provided.
We are committed to protecting your privacy. Our Privacy Policy explains how we collect, use, and protect your personal information. By making a booking, you consent to the collection and processing of your personal information as described in our Privacy Policy.
We may need to disclose your personal information to our Travel Suppliers and other third parties to fulfill your booking. This may include transferring your information outside the European Economic Area to countries that may not have data protection laws as strict as those in the United Kingdom.
By participating in our tours, you grant us permission to use photographs or videos taken during the tour that include your image for promotional purposes in any media without compensation. If you prefer not to be photographed, please inform your tour guide.
We may request feedback about your tour experience. By submitting reviews or testimonials, you grant us permission to use them in our marketing materials, including our website and social media channels. We may edit testimonials for clarity or length while preserving the general sentiment.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
We reserve the right to update or modify these Terms at any time without prior notice. The current version will be posted on our website with the effective date. Your continued use of our website or services after any changes indicates your acceptance of the modified Terms.
For bookings already confirmed, the Terms in place at the time of booking will apply, unless you expressly agree to the updated Terms.
